Mr. Frederick scored a significant victory when the United States Court of Appeals for the Third Circuit vacated a district court’s order dismissing a proposed consumer rights class action lawsuit against Ambit Energy. In Silvis v. Ambit Energy, et al., Defendant Ambit Energy is accused of charging exorbitant electricity rates and breaching its contract with Ms. Silvis and the Proposed Class by failing to set its rates based on the factors outlined in its contract. Because of this significant victory in the Third Circuit, Ms. Silvis was able to reach a class-wide final settlement with Ambit Energy which made $9.3 Million available to the class of Ambit Energy’s Pennsylvania customers. The case caption is: Silvis v. Ambit Energy, L.P., et al., United States District Court for the Eastern District of Pennsylvania, Civil Action No. 14-cv-5005. Mr. Frederick represents the plaintiff in this case, and has been appointed Class Counsel representing all class members.

Mr. Frederick is co-counsel in a proposed nationwide class action lawsuit, filed in the United States District Court for the District of Colorado, against Air Methods Corporation and Rocky Mountain Holdings, LLC, related to alleged overcharging for emergency medical helicopter transport. In many instances, victims have been billed more than $47,000 for less than 100 miles of emergency medical helicopter transportation and have been denied any opportunity to contest the bill. This case is currently pending before the United States Court of Appeals for the 10th Circuit. Mr. Frederick is pleased to announce that a $1,250,000 settlement has been reached in a class action lawsuit against U.S. Gas & Electric, Inc., Energy Services Providers, Inc., and Pennsylvania Gas & Electric (collectively, “PAG&E”). The case is caption is: Sobiech v. U.S. Gas & Electric, Inc., United States District Court for the Eastern District of Pennsylvania, Civil Action No. 2:14-cv-04464. Mr. Frederick represented the plaintiff in this case, and has been appointed Class Counsel representing all class members.
